Terms of Service
Effective Date: September 15, 2026
Welcome to Bin Rescue NJ. These Terms of Service (“Terms”) govern your use of the Bin Rescue NJ website and any trash bin, recycling bin, garbage can cleaning, sanitizing, deodorizing, or related services provided by Bin Rescue NJ (“Bin Rescue NJ,” “we,” “us,” or “our”).
By using our website, scheduling a service, purchasing a one-time cleaning, checking a booking box, or enrolling in a recurring service plan, you agree to these Terms. If you do not agree, do not use the website or request service.
These Terms are a business document and are not a substitute for advice from a New Jersey attorney.
1. Services
Bin Rescue NJ provides professional curbside trash and recycling bin cleaning services to residential customers within our designated service areas.
Services may include high-temperature washing, sanitizing, deodorizing, and cleaning of residential trash and recycling containers.
Available services, schedules, pricing, service areas, and frequency options may change from time to time.
We do not provide hazardous-waste disposal, dumpster service, interior home cleaning, or municipal collection.
2. Customer Responsibilities
Customers are responsible for making their trash or recycling bins reasonably accessible on the scheduled service date.
Unless otherwise arranged in writing, bins should be:
- Empty of household trash, recycling, loose debris, and other contents.
- Accessible from the street, curb, driveway, or other agreed-upon service location.
- Free from vehicles, gates, locks, animals, or other obstructions that prevent service.
- In a condition that allows them to be safely handled and cleaned.
You represent that you own the containers or have legal authority to request service, for example as homeowner, authorized tenant, or with HOA or landlord permission. If you do not have that authority, you are responsible for any resulting claim.
You must disclose, before we arrive, any known hazards that affect safe access or handling, including aggressive pets, bite history, loose animals, broken lids or wheels, needles or sharps, chemicals, or other unsafe conditions.
3. Pets, Children, and Site Safety
Pets must be secured indoors or otherwise kept away from the work area, truck, hoses, and equipment during service.
Children should be kept clear of the work area.
If an animal, occupant, traffic condition, ice, flooding, biohazard, infestation, or other condition creates an unreasonable safety risk for our employees or contractors, we may refuse or stop service immediately.
Abusive, threatening, harassing, or intoxicated conduct toward our employees or contractors is grounds for immediate cancellation of current and future service.
4. Service Scheduling
Service dates may be coordinated with local trash and recycling collection schedules when practical.
Scheduled service dates and arrival times are estimates and may change because of collection delays, weather, equipment issues, traffic, holidays, route changes, or other circumstances outside our reasonable control.
Customers do not need to be home during service unless otherwise arranged.
5. Missed or Inaccessible Bins
It is the customer's responsibility to ensure that bins are available for service.
If we arrive and a bin is unavailable, full, inaccessible, locked behind a gate, blocked by a vehicle, left with an unsecured animal, or otherwise cannot reasonably or safely be serviced, the visit may be treated as a missed service.
Depending on the circumstances and service plan, we may attempt to reschedule. Additional charges may apply when a special return trip is requested. A missed stop caused by customer conditions may still be billable.
6. Recurring Service Plans
Customers who enroll in a recurring plan authorize Bin Rescue NJ to provide services at the frequency selected during enrollment.
Recurring plans may include weekly, bi-weekly, monthly, quarterly, or other available service frequencies.
Unless otherwise stated during enrollment, recurring service continues until canceled under Section 9.
Service schedules may be adjusted because of holidays, weather, municipal collection changes, route optimization, or other operational requirements.
7. One-Time Services
One-time services apply only to the cleaning visit purchased and do not automatically create a recurring plan unless you separately enroll.
Additional bins or services requested beyond the original order may result in additional charges.
8. Pricing and Payment
Current pricing is displayed on our website or communicated before service.
You agree to pay all applicable charges for the services you select.
For recurring plans, you authorize the payment method provided during enrollment to be charged on the selected billing schedule.
Prices, promotions, discounts, and plans may change. Changes will not retroactively affect services already purchased unless otherwise agreed.
Promotional offers and discount codes may have separate eligibility rules, expiration dates, and restrictions.
Failed or reversed payments may result in suspension of service. You agree to pay reasonable collection costs we incur to recover undisputed amounts owed for completed or properly scheduled service.
Chargebacks for completed, documented service are not an accepted form of cancellation.
9. Cancellations and Changes
Please give reasonable notice before the scheduled service date if you need to cancel or change a visit.
Recurring customers may cancel future service through the process we make available in our scheduling and billing system.
Cancellation does not eliminate charges for services already completed or properly scheduled before the cancellation became effective.
We may discontinue service for nonpayment, repeated inaccessible bins, unsafe conditions, misuse of the service, abusive conduct toward employees or contractors, lack of authority to request service, or other circumstances that make continued service unreasonable.
10. Refunds
Charges for completed services are generally non-refundable.
If we are unable to provide a paid service for reasons within our control, we may reschedule, issue a service credit, or provide a refund, depending on the circumstances.
Questions about a charge should be sent to us as soon as reasonably possible.
11. Weather and Service Delays
Services may be postponed or rescheduled because of severe weather, freezing conditions, storms, flooding, unsafe road conditions, equipment problems, municipal disruptions, or other circumstances that make cleaning unsafe or impractical.
A weather-related reschedule is not a cancellation of your plan.
We are not responsible for frozen residual rinse water, temporary wet pavement, or related slip hazards after we leave the site.
12. Condition of Bins; Handling and Movement
We use professional methods intended to clean, sanitize, and deodorize residential containers. We do not guarantee removal of every stain, discoloration, odor, adhesive, paint mark, hardened residue, scratch, or pre-existing condition.
Normal cleaning may reveal existing scratches, cracks, fading, deterioration, or other damage previously hidden by dirt or residue.
You authorize us to move bins as reasonably needed to perform the service and to return them to the same general location.
We are not responsible for:
- Normal wear, pre-existing damage, manufacturer defects, brittle or sun-damaged plastic, failed wheels or lids, or deterioration from age, weather, chemicals, waste, municipal collection equipment, or prior use.
- Marks, scuffs, or cosmetic changes that occur in the ordinary handling of containers.
- Incidental overspray, rinse water, or runoff onto pavement, grass, or nearby surfaces during ordinary outdoor cleaning.
- Drainage problems on the property, including water that pools because of grade, blocked drains, or poor site drainage.
If you do not want incidental splash on vehicles, windows, patio items, or nearby surfaces, move those items or close those windows before service.
13. Hazardous or Prohibited Materials
Do not knowingly leave hazardous, dangerous, illegal, flammable, corrosive, infectious, or toxic materials in containers presented for cleaning.
Examples include chemicals, gasoline, solvents, paint, medical waste, needles or other sharps, explosives, pesticides, batteries, unbagged human or animal waste beyond incidental residue, wet cement or plaster, and large volumes of grease or oil.
We may refuse service when a container presents a safety, environmental, or contamination risk. We are not a hazardous-waste hauler.
14. Property Access
When you request service that requires access to private property, you authorize our personnel or contractors to enter the reasonably necessary portion of the property to perform the requested service.
You are responsible for identifying gates, codes, access instructions, pets, hazards, or other conditions that affect safe access.
If you live in a gated community or require a driveway pull-in for safety, you authorize that access and remain responsible for providing working codes and a safe path.
15. Photographs and Documentation
We may photograph containers and the immediate work area before, during, and after service for quality control, training, billing disputes, and marketing.
We will not intentionally publish faces, license plates, or readable house numbers without separate consent. Bin-only photos may be used without further approval.
16. Communications
By scheduling service or creating an account, you consent to transactional calls, emails, and text messages about scheduling, routing, service status, and billing.
Marketing messages, if any, require separate opt-in where required by law. You may opt out of marketing texts as instructed in the message. Transactional service messages may still be sent while you have an active plan.
17. Claims for Alleged Damage
Any claim that we damaged a bin or nearby property must be reported to us in writing as soon as reasonably possible, and in any event within seventy-two (72) hours after the service visit, and must include photos and a description of the claimed damage.
We may inspect the site or container before accepting responsibility.
We are not responsible for damage except to the extent caused by our negligence or willful misconduct. Pre-existing conditions, municipal collection damage, brittle plastic failure, and ordinary handling marks are not our responsibility.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Bin Rescue NJ, its members, officers, employees, agents, and independent contractors will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services.
Our liability for a claim arising directly from a cleaning service will generally be limited to the amount paid for the specific service giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot legally be limited under New Jersey law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Bin Rescue NJ and its members, officers, employees, agents, and independent contractors from and against claims, damages, losses, and reasonable expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your breach of these Terms.
- Hazardous, prohibited, or undisclosed contents of a container.
- Pets, children, vehicles, gates, locks, or other conditions you failed to control or disclose.
- Your lack of authority to request service on the containers or property.
- Third-party claims arising from your property, your containers, or your instructions.
This obligation does not require you to indemnify us for our own negligence or willful misconduct to the extent New Jersey law prohibits that result.
20. Website Use
Content on the Bin Rescue NJ website is provided for general information about our company and services.
You may not attempt to interfere with the operation or security of the website, misuse website forms, access systems without authorization, or use the website for unlawful purposes.
Text, graphics, logos, photographs, designs, and other original website content may be protected by intellectual property laws and may not be reproduced or commercially used without permission.
21. Third-Party Services
We may use third-party providers for scheduling, payments, customer accounts, website hosting, communications, maps, analytics, or other business functions.
Use of those services may also be subject to the applicable provider’s terms and privacy practices.
22. Privacy
Information collected through the website or during service is handled according to our Privacy Policy. Please review that policy for how personal information may be collected, used, stored, and shared.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal requirements.
Updated Terms will be posted on this website with a revised effective date. Continued use of our services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by law.
24. Miscellaneous
These Terms, together with any order confirmation, posted pricing, and our Privacy Policy, are the entire agreement between you and Bin Rescue NJ regarding the website and the services.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign these Terms without our written consent. We may assign these Terms in connection with a sale of the business or similar transaction.
Electronic acceptance, including checking a box, completing an online booking, or enrolling in a plan, has the same effect as a handwritten signature.
25. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
Any dispute relating to these Terms or Bin Rescue NJ services will be handled in an appropriate court with jurisdiction in New Jersey, unless applicable law requires otherwise.
